If you already have a business and are thinking about franchising it, you need to familiarise yourself with the Franchising Code of Conduct (“Code”). You will need a lawyer to draft up your franchise agreement and disclosure document and provide you with advice in relation to compliance with the Code. It is possible to still call your agreement by a name other than a ‘franchise agreement’. Some of our clients still call their agreements, dealer agreements, member agreement or licence agreements.
