I have a distribution agreement and I think it might actually be a franchise agreement

Many agreements, despite their title, are actually franchise agreements due to the broad definition in the Franchising Code of Conduct. 

If you have a licence agreement, distribution agreement, member agreement or other similar arrangement you should check with your legal advisor whether it is actually a franchise agreement. 

If you have the right to use a name specified by the other party, you are paying fees and there is a system to follow or a suggested marketing plan as part of the agreement, then you should check the characterisation as it may actually be a franchise agreement.
