How will the new Code of Conduct affect you?

Sarah Stowe

What do you need to know about the new Franchising Code of Conduct?

Legislation to amend the Competition and Consumer Act to give effect to new penalties for certain breaches (court awarded fines of up to $51,000 and ACCC powers to issue infringement notices of $8,500 per breach) will take effect 1 January 2015 when the new Code comes into effect.

Michael Paul, chairman of the Franchise Council of Australia, says the new legislation is “the most significant change to franchising regulation since the enactment of the Code in 1998, and represents the final part of the comprehensive review of franchising regulation that commenced in early 2013.”

The Franchise Council of Australia has stepped up to provide a series of free, exclusive forums to help its member franchisors navigate their way through the new regulation.

What you will learn

  • how the new Code will apply
  • exemptions from updating
  • new updating time frames
  • what good faith is likely to mean
  • how end of term arrangements will affect restraint of trade clauses
  • and the changes you need to make to your agreements, disclosure documents and processes
