FCA introducing Member Standards
While the ACCC Franchising Code of Conduct is working well – allowing for disclosure provisions, dispute resolution procedures and general guidelines for the sector – some ‘grey areas’ remain regarding franchise relations, which cannot adequately be legislated for.
Therefore, the Franchise Council of Australia (FCA) is introducing a set of Member Standards designed to fill in the ethical gaps. The new Member Standards make available a complaints officer to all members, and provide recourse for injured parties in franchise disputes. Procedures have no legal ramifications, however, adverse findings may result in a member being censured or expelled from the FCA.
