Intellectual Property

Entities and individuals are now much more aware of the value of intellectual property, including papers, designs, materials capable of copyright, Trade Marks, logos and similar.

The Trade Mark and logo registration and opposition procedure is not unduly complex, but in the instances where applicants are opposed Ivan Poole Lawyers assists clients with their opposition by using a combination of application and opposition procedures to effectively reach a commercial decision.

These are cases where commercial sense, coupled with legal knowledge, has prevailed in averting a lengthy and expensive opposition procedure, and yet each party is satisfied with the result achieved with minimal time, effort and expense.

Ivan Poole Lawyers has considerable experience worldwide in Trade Mark matters, and in particular, over the past few years has been involved in a number of matters involving trade mark opposition. Ivan Poole - Principal

Ivan Poole was admitted as a solicitor in New Zealand in 1965 and has practised at partnership level since that time in New Zealand, Hong Kong and Gold Coast Australia since August 1980.

Ivan has extensive experience in franchising, licensing, distribution and intellectual property for over 25 years acting for over 100 franchise systems.

Ivan is also vastly experienced in Dispute Resolution in franchising and other commercial matters and is an Accredited Mediator in Australia.

• Creation of complete sets of documents compliant with the Franchising Code of Conduct for new franchise systems - both in Australia and overseas. 
• Advising Franchisors from inception through to successful sale. 
• Review of documentation and management of Contract of Sale for Franchisees buying and selling franchised businesses.

Peter Thelwell - Solicitor

Peter was awarded his Law Degree with Honours in the UK in 2005 before working for 3 years as an in-house counsel with Rolls Royce.

Peter was admitted as a solicitor in Queensland in 2009, having completed his Postgraduate Legal Training at Bond University.

Since joining Ivan Poole Lawyers in January 2009, Peter has developed his knowledge of Franchising Law and Intellectual Property Law under Ivan Poole.
